Terms of Service

1. Acceptance of Terms

By accessing or using SuperEngage ("the Platform"), you agree to these Terms of Service. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Platform Access

SuperEngage grants you a limited, non-exclusive, non-transferable licence to access and use the Platform for your internal business purposes during your subscription term. You may not resell, sublicense, or provide access to third parties without our written consent, except as permitted under our Partner Program.

3. Acceptable Use

You agree not to: (a) use the Platform to send spam or unsolicited communications; (b) attempt to gain unauthorised access to any part of the Platform; (c) reverse-engineer, decompile, or create derivative works from the Platform; (d) use the Platform in violation of applicable laws or regulations.

4. Data Ownership

You retain ownership of all data you upload to or generate using the Platform. We process this data as a data processor on your behalf, as described in our Data Processing Agreement. We do not sell your data.

5. Subscription & Payment

Subscriptions are billed per user per month or annually as selected. Annual plans are billed in advance. Monthly plans are billed at the start of each billing period. All fees are non-refundable except as required by law.

6. Service Availability

We maintain a 99.9% uptime SLA for the Platform, excluding scheduled maintenance. Status updates are available at status.superengage.one. In the event of extended downtime, credits will be applied per our SLA terms.

7. Termination

Either party may terminate this agreement with 30 days written notice. We may terminate immediately for material breach. Upon termination, you may export your data within 30 days after which it will be deleted.

8. Limitation of Liability

To the maximum extent permitted by law, SuperEngage's liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

9. Governing Law

These terms are governed by the laws of India. Disputes will be resolved by arbitration in Bengaluru, India under the Arbitration and Conciliation Act, 1996.
